Chapter 13 Bankruptcy Does not stay on your Credit Report as long as a Chapter 7

People often ask “How long will this Bankruptcy stay on my Credit Report”?  The answer depends on the type of Bankruptcy you file.  A Chapter 7 Bankruptcy will stay on your Credit Report for 10 years from the date of filing.  A Chapter 13 Bankruptcy will stay on your Credit Report for 7 years from the date of filing.  Consequently, a Chapter 7 Bankruptcy stays on your Credit Report as long as all other debt. That being said, most of my clients receive offers of credit as soon as their Bankruptcy is completed, irrespective of whether they filed a Chapter 7 or a Chapter 13.
